A Hamburg court has ruled that moderators of internet forums are liable for content posted on their sites.
I'd never run a forum like this one on a German webserver now. The German lawmaker, in its infinite incompetence and lobbyist corruption, has virtually made it impossible for ordinary people without major legal funds to operate "interactive" web sites without having to fear law suits or, more likely, random and expensive cease-and-desist orders by unscrupulous third-grade lawyers who operate this grey area business as their primary income constituent. Basically, if you operated a forum like this one, you'd have to actively censor it, that is, read each posting before publishing it, and you'd be held liable for anything upwards from something as simple as unauthorized use of trademarks, even if it's clear that it's a mere coincidence, and for subsequent costs and damages like for "removing from search engines", which can be enormous or practically impossible to comply with. There're a few more regulations pertaining to httpd logfiles and registered user data which I haven't bothered reading up on in detail but apparently they're equally stupid and impracticable.
Plus you're actually comitting an offence if you don't publish your full name, address and telephone number on your private website (of course most people don't do this, for obvious reasons... you don't want nutters, neonazis, religious fanatics or plain criminals kicking in your door because they might've found something offensive on your blog... the rationale behind this insanity is "consumer protection"... protecting the dimwitted from getting ripped off online (as if this were possible) but "consumers" can certainly chose not to "consume" my website, except that politicians don't really understand this minor detail, and the lobbyist "experts" they pay with tax money are experts only in discombobulation...)
The latest fad in the German lawmaker's hate-hate relationship with the Internet are proposals that allow for covert government hacking into your home computer (allegedly in the name of the "war on terror") and for banning egoshooters (counter-strike, doom, quake) in the same way as child pornography, even with prison sentences for possession(!) [although they are slowly backing away from that one, except for some obstinately dumb/corrupted specimen, after slowly having gotten wind of --to their surprise-- the fact that the target group they chose to polemicize against for political gain is actually far larger than expected and comprises not only a few pimply-faced unemployed perverts and amok-training pupils but quite a few of their own potential voters from their constituency, too...]
Politicians and the 'net.. they can't control it, they know absolutely nothing about it because most don't use computers themselves (too old/busy/stupid), and, naturally, they fear it. If only they feared the people as much. :urff::urff:

If I start stripping and calling people assholes on a train, we can sue the Belgian Railways.

When I'm in Sixflags and enjoying the rollercoaster yelling "oh! I am so gay! Are you gay too, people?" one can sue Sixflags' asses off.

Utter bollox. They'd better start a posse against all spambots, but they know that's harder and more work, so they pick an easier target.

Utterly unenforcable.

If an American person puts up a post on a UK hosted server that insults a Czechoslovakian, where does one even begin? Call in the UN! Call in Interpol!
